Quick answer

When an ATO debt letter arrives, don't ignore it and don't panic-borrow. First lodge any overdue BAS and check your portal balance. Then ask about a payment plan. If a plan isn't available or affordable, or director penalties or credit reporting are a risk, a fast loan can clear the debt, often paid to the ATO directly. Property-secured options suit larger debts.

Key points

  • Read the letter carefully; the type of notice decides the urgency.
  • Lodge overdue BAS first so the real number is known.
  • Ask the ATO about a payment plan before borrowing.
  • If borrowing, lenders can often pay the ATO directly.

Lodge, check portal, call the ATO
Alternative

Unsecured or property-secured
Urgent if
Director penalty notice or garnishee

An envelope from the ATO lands, or an email from your tax agent says the ATO has been in touch. Your stomach drops. For a lot of owners, tax debt has been building quietly for a while, and the letter makes it real.

The worst responses are ignoring it or grabbing the first loan you can find. There’s a better order of operations, and it often means borrowing less, or not at all.

Step 1: Read what kind of letter it is

ATO correspondence ranges from gentle reminders to serious enforcement. The type matters:

Type of notice What it usually means Urgency
Statement or reminder A balance is overdue Act soon
Letter about lodgements BAS or returns are missing Lodge promptly
Warning of credit reporting Debt may be reported to credit bureaus High
Director penalty notice Directors may become personally liable Very high; strict deadlines
Garnishee notice The ATO can collect from your bank or customers Very high

If it’s a director penalty notice or garnishee notice, contact your tax agent or adviser the same day. Those have strict timeframes and consequences that a loan alone may not fix.

Step 2: Lodge and get the real number

Lenders, and the ATO, need to know exactly what’s owed. If any BAS or returns are outstanding, lodge them, even if you can’t pay yet. Then download a current portal statement. That one page is what any lender will ask for, and it’s often smaller or larger than owners expect.

Step 3: Ask the ATO about a payment plan

For many businesses, a payment plan is the cheapest answer. Smaller debts can often be set up online. The ATO generally prefers working with businesses that engage early. If the plan is affordable and you can stick to it, you may not need a loan at all.

When a loan makes sense

Borrowing to clear tax debt can be the right call when:

  • A payment plan isn’t offered, isn’t affordable or has already defaulted.
  • The debt is close to being reported to credit bureaus, which could hurt your supplier and lender relationships.
  • Directors face personal liability and want the company debt cleared.
  • ATO interest charges are adding up. From 1 July 2025, the general interest charge and shortfall interest charge are no longer tax deductible, which changes the comparison with other finance.

How fast it can move

For smaller debts and a trading business with clean recent banking, an unsecured loan can work, with same-day funding possible for smaller amounts once the file is complete. Larger debts usually need a longer term to keep repayments manageable, which points to a property-secured loan: $20k to $250k is possible same day once title, value and signers are sorted, and up to $5m possible within 24–48 hours. Lenders often pay the ATO directly at settlement.

What to have ready

  • Your current ATO portal statement.
  • Confirmation that all lodgements are up to date.
  • The letter or notice itself.
  • Details of any existing payment plan and how it’s been met.
  • Linked bank statements and ID for each director.
  • For property-secured loans, the property address, value and loan balance.

An illustrative example

A Cairns tour operator receives a letter warning that its $74,000 tax debt may be reported to credit bureaus. Two quarters of BAS were lodged late after a slow wet season, and an earlier payment plan defaulted. The directors lodge everything outstanding, confirm the balance on the portal and ask the ATO about a new plan, which would need larger instalments than the business can manage in the off season. They take a property-secured loan over two years, paid directly to the ATO, with repayments that fit the business’s annual cycle. Illustrative only.

Don’t let the letter push you into the wrong loan

A frightening letter makes any fast loan look like relief. But a short, expensive loan that you can’t repay on time just swaps one problem for another. If the debt is large relative to the business, a longer term, even secured on property, usually serves you better than the quickest unsecured option. And if the business is losing money, speak to your accountant before borrowing at all.

Stop the next letter

Once the debt is cleared, the most valuable change is a separate tax account. Move a fixed share of every deposit into it for GST and PAYG, so the next BAS is already covered. Monthly BAS can also make amounts smaller and easier to manage. Lenders like seeing a plan like this, and so does the ATO.

Talk it through

Tell us what kind of letter arrived, what’s owed and whether your lodgements are up to date. Asking doesn’t touch your credit file, we don’t push your details out to a dozen lenders, and one real person reads it and calls you. Accurate figures help us tell you honestly whether a loan or a payment plan is the better first step. Start your enquiry.

Frequently asked questions

Is every ATO letter urgent?

No. A reminder is different from a director penalty notice or a garnishee notice. Read the letter type and the dates, and get your tax agent to check it if unsure.

What is a director penalty notice?

A notice that can make company directors personally liable for certain unpaid company amounts like PAYG withholding and super. It has strict timeframes, so get advice quickly.

Can I get a loan if I haven't lodged?

It's very difficult. Lenders need the real amount owed, which means lodging. Lodge even if you can't pay.

Will the ATO report my debt?

The ATO can report business tax debts that meet certain criteria to credit reporting bureaus. Engaging early and setting up a payment plan can avoid that.
